These terms apply to purchases made directly through lesleeartist.com. Artwork purchased through a gallery, exhibition, or other third party is subject to the terms and policies of that seller.
1. Original Artwork and Availability
Most original artworks offered through this website are one-of-a-kind.
I make reasonable efforts to keep artwork availability, pricing, descriptions, and other information current. However, paintings may also be shown or offered through galleries, exhibitions, plein air events, or other venues. On rare occasions, an artwork may sell elsewhere before the website has been updated.
If an artwork is no longer available after an online order has been placed, I will contact the purchaser and issue a full refund of any payment received for that artwork.
I reserve the right to correct errors in pricing, descriptions, availability, dimensions, or other information and to cancel or decline an order when reasonably necessary.
2. Artwork Images and Color
I make every reasonable effort to represent my artwork accurately through photographs and descriptions.
Because original paintings contain subtle variations in color, value, texture, surface, and reflected light, the appearance of an artwork may vary depending on photography, lighting conditions, monitors, phones, tablets, and other displays.
Such differences are normal and are not considered defects in the artwork.
3. Copyright and Intellectual Property
Unless otherwise stated, all original artwork, images of artwork, photographs, written content, graphics, designs, and other original material appearing on this website are owned by Les Lee and are protected by applicable copyright and intellectual property laws.
Purchasing an original artwork transfers ownership of the physical artwork only. Copyright and reproduction rights remain with Les Lee unless those rights are expressly transferred in a separate written agreement.
Without prior written permission, artwork or images from this website may not be reproduced, copied, published, distributed, sold, licensed, commercially exploited, modified, or used to create derivative products or works.
This includes, without limitation, use on prints, merchandise, publications, advertising, digital products, NFTs, or other commercial applications.
Images, artwork, text, and other original content from this website may not be used to train, fine-tune, develop, evaluate, or provide input to artificial intelligence or machine-learning systems without prior written permission from Les Lee.
Limited sharing of links to this website or its public pages for personal, editorial, or noncommercial purposes is permitted so long as the content is not altered and proper attribution is provided.

4. Prices and Payment
Prices shown on this website are listed in U.S. dollars unless otherwise stated.
Artwork prices may change without prior notice. A price change will not affect an order that has already been accepted and paid.
Shipping, handling, insurance, taxes, customs charges, and other applicable costs may be additional to the listed artwork price.
Payment is processed through third-party payment providers used by this website. Les Lee Fine Art does not directly store complete credit-card information.
I reserve the right to decline or cancel an order in cases of suspected fraud, pricing error, duplicate sale, payment failure, or other reasonable circumstances.
5. Shipping Destinations
Online checkout is currently intended primarily for shipments within the United States.
International collectors are welcome to contact [email protected] to inquire about purchasing and shipping an artwork outside the United States.
International sales and shipping will be considered on a case-by-case basis based on destination, cost, insurance availability, customs requirements, sanctions, import restrictions, taxes, duties, and other applicable considerations.
Unless otherwise agreed in writing, international purchasers are responsible for customs duties, import taxes, VAT, brokerage fees, and other charges imposed by the destination country or carrier.
6. Shipping Costs
Unless otherwise stated on an individual artwork listing, shipping, handling, packing, and insurance are additional to the purchase price.
Shipping charges may be calculated during checkout or quoted separately depending on the size, value, destination, framing, and shipping requirements of the artwork.
Expedited shipping or special delivery arrangements requested by the purchaser may be available at additional cost.
7. Processing and Shipping Time
Original artwork is carefully prepared and packaged for shipment.
Most orders will be shipped as promptly as practical. Please allow up to 10 business days for an artwork to be prepared and released to the carrier.
Some artwork may require additional time, including:
- large or unusually sized paintings;
- works requiring custom packing or crating;
- recently completed oil paintings that need additional drying time;
- artwork requiring special shipping arrangements.
If a significant delay is anticipated, I will contact the purchaser.
8. Large and Oversized Artwork
Large, oversized, unusually shaped, or heavily framed artworks may require special packing, crating, freight service, or other delivery arrangements.
In such cases, I may contact the purchaser before shipment to discuss available options and costs.
In some circumstances, an unstretched canvas may be shipped rolled rather than stretched and framed. Any such arrangement will be discussed and agreed upon before shipment.
If a canvas is shipped rolled, stretching, mounting, and framing at the destination are the purchaser’s responsibility unless otherwise agreed.
9. Damage During Shipping
Original artwork shipments are generally insured against loss or damage in transit.
If an artwork or its frame arrives damaged, please contact [email protected] as soon as possible, preferably within 48 hours of delivery.
Please:
- retain the artwork and all original packaging materials;
- photograph the exterior of the package, particularly if visible damage is present;
- photograph the interior packaging;
- photograph the artwork, frame, and damaged areas clearly;
- do not discard packaging or attempt repairs before contacting me.
The carrier or insurer may require photographs, inspection, or retention of the original packaging as part of a claim.
I will work with the purchaser to determine an appropriate resolution. Depending on the circumstances, this may include repair, return, refund, replacement of a frame, an adjustment to the purchase price, or another mutually agreeable solution.
Because original artwork is unique, the appropriate resolution may vary depending upon the nature and extent of the damage.
10. 30-Day Collector Satisfaction Guarantee
I want collectors to be pleased with original artwork purchased directly from me.
If an original artwork purchased directly through this website is not right for you, please contact [email protected] within 30 days of delivery to arrange a return.
Do not return artwork without contacting me first.
To be eligible for a return:
- the artwork must be in its original condition;
- it should be returned in its original packaging whenever practical;
- it must be adequately packed for safe transport;
- the return shipment must be insured for the purchase price;
- a trackable shipping method must be used.
Unless the return results from an error on my part or is being handled under the shipping-damage provisions above, the purchaser is responsible for return packing, shipping, and insurance.
The purchaser remains responsible for the artwork until it is safely received.
After the returned artwork has been received and its condition verified, the purchase price of the artwork will be refunded.
Original shipping, packing, handling, insurance, expedited delivery charges, customs charges, and other delivery-related costs are not refundable unless the return resulted from an error on my part.
Artwork that has been damaged after delivery, altered, modified, reframed, removed from its original mounting, or otherwise changed may not be eligible for return.
11. Commissions and Custom Artwork
Commissioned artwork, customized artwork, and works created specifically for an individual purchaser are generally not covered by the standard 30-day return policy.
Terms for commissions, including subject matter, dimensions, price, deposits, revisions, completion time, shipping, approval, cancellation, and reproduction rights, may be established separately in writing.
If a separate commission agreement conflicts with these Terms & Conditions, the commission agreement will control with respect to that commission.
12. Gallery and Third-Party Purchases
Artwork purchased through Pearl Gallery or another gallery, exhibition, retailer, event, or third-party seller is subject to that seller’s payment, shipping, return, and other policies.
The 30-Day Collector Satisfaction Guarantee described above applies only to qualifying purchases made directly through lesleeartist.com, unless otherwise agreed.
13. Website Use
You agree not to use this website for unlawful purposes or in a manner that interferes with the operation, security, or availability of the site.
You may not:
- attempt unauthorized access to the website or related systems;
- introduce malicious code, viruses, or other harmful technology;
- scrape, harvest, or systematically extract website content for commercial purposes;
- collect personal information about other users without authorization;
- impersonate another person;
- use the website in a manner that infringes the intellectual property rights of Les Lee or others.
14. Third-Party Websites and Services
This website may contain links to galleries, social-media platforms, payment processors, shipping providers, email services, or other third-party websites and services.

Information provided for purchases may be used as reasonably necessary to process payment, fulfill orders, arrange shipping, communicate about a transaction, prevent fraud, and comply with legal or accounting requirements.
Joining The View from Here email list is voluntary and is governed by the applicable email subscription and privacy practices.
16. Disclaimer and Limitation of Liability
I make reasonable efforts to maintain an accurate, secure, and functional website, but I do not guarantee that the website will always be uninterrupted, error-free, or available.
To the fullest extent permitted by applicable law, Les Lee Fine Art and Les Lee will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of this website or services provided through it.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Les Lee and Les Lee Fine Art from claims, damages, liabilities, and reasonable costs arising from your unlawful use of this website, your violation of these Terms, or your infringement of the rights of another person or entity.

These Terms & Conditions and transactions made through this website are intended to be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
This section may be revised or supplemented if a specific jurisdiction or venue provision is later adopted.

These Terms & Conditions may be updated from time to time to reflect changes in business practices, website features, legal requirements, or policies.
